EU to Introduce European Product Act to Tighten Import Regulation on Cross-Border E-Commerce

AMZ123 has learned that, according to leaked draft contents recently disclosed by Euronews, the European Commission has begun preparing a new legislative proposal, the European Product Law, which is expected to be officially released on October 6.

The core purpose of this legislation is to close enforcement gaps in existing market surveillance, strictly control the entry of non-compliant products into the EU single market, and focus on tackling irregularities involving low-value goods imported through cross-border e-commerce channels. The draft clearly states that the current EU market surveillance system has obvious loopholes, and for non-compliant products sold online or imported directly from third countries, there has long been a lack of efficient identification and removal mechanisms, allowing many problematic products to remain in the EU market.

Although the draft does not directly mention any country by name, given the background to its introduction, the new rules are highly targeted. In recent years, low-value import parcels in EU cross-border e-commerce have surged, and trade issues related to platforms such as Temu and Shein have become increasingly prominent. Coupled with the pressure from the EU's average daily trade deficit with China of about €1 billion in 2025, this legislation is intended to address the above issues and close trade regulatory gaps.

The new rules contain several core regulatory adjustments, tightening market access rules for cross-border products in all respects. First, the law will significantly strengthen the legal responsibilities of online trading platforms, explicitly requiring that all foreign products circulating in the EU must be covered by compliant operators within the EU, such as importers or authorized representatives, to assume responsibility, thoroughly closing loopholes that allow overseas cross-border sellers to evade supervision and accountability.

Second, the EU will consolidate and upgrade its product market surveillance system, optimize the unified supervision model, and improve overall regulatory efficiency. At the same time, the new rules introduce a supervision fee mechanism for cross-border products, under which fees will be charged based on the assessed cost of products entering from third countries.

In addition, before placing any goods on the EU market, online platforms must verify product compliance credentials and confirm that products have a digital product passport or a manufacturer's responsibility filing record, providing a basis for product traceability, compliance checks, and accountability.

The implementation of these new rules is another important step in the EU's continued tightening of cross-border trade supervision in recent years. The EU has already abolished tariff exemption policies for imported parcels below €150 and has continued to increase penalties for non-compliant cross-border platforms. Earlier, the EU fined Temu €200 million over non-compliant products such as dangerous baby toys and defective chargers, and launched a dedicated compliance investigation into Shein.

If the European Product Law is formally implemented, it will further raise the compliance threshold for overseas cross-border e-commerce entering the EU market and increase the market entry operating costs for enterprises.

At present, the law is still in the draft public consultation stage, and its content has not been finalized. The official text and specific implementation rules are subject to the European Commission's subsequent official release.
