Alibaba International Station Adds Interpretation of Compliance Requirements for EU Principals

1. Compliance Background

In response to the full implementation of the EU's General Product Safety Regulation (GPSR), the platform has set clear compliance requirements for merchants selling non-food consumer products to the EU market. The vast majority of non-food consumer goods sold to the EU must have EU responsible person information (the EU responsible person designated by domestic merchants is usually the Authorized Representative, abbreviated as "EU rep", which refers to the "EU responsible person" in this article for ease of understanding).


During regulatory enforcement reporting and platform inspections, the platform has found that some merchants do not have compliantly entrusted EU reps, their EU rep agreements have expired, or the EU responsible person information used is false. The above issues will cause merchants to violate the GPSR regulations, and the products sold to the EU will be illegal goods, and the platform has the obligation to remove them.


2. Interpretation of New Compliance Requirements

To better meet regulatory and supervisory requirements and protect buyers' rights and interests, the platform has officially launched three EU responsible person control mechanisms:



Special reminder: If the EU rep is invalidated by the platform at any stage (including after passing the verification mechanism) for any reason (including being reported by EU regulators), the products associated with that EU rep will be subject to EU traffic blocking and cannot be traded with EU buyers. The losses caused by the association with an invalid EU rep shall be borne by the merchant or claimed from the EU rep. To protect the rights and interests of merchants, the platform reminds merchants to consult EU lawyers and contact real EU reps in the EU region for compliant product listing. Both the platform and merchants have the obligation to comply with EU regulations and supervisory requirements, and any violators may face EU regulatory penalties.


3. Merchant Operation Guide

(a) EU Rep Prohibition Mechanism


If a merchant tries to upload prohibited EU rep information, the system will reject the request and the review will not pass.

The above list is case-insensitive, and the platform will update this list periodically.


(b) EU Rep Verification Mechanism


Merchants need to upload valid authorization agreements and other supporting documents within 15 days for platform verification. If not provided within the time limit or if the provided materials are false, the EU rep will become invalid.


1. Platform verification notice: Log in to the My Alibaba-Service Center-Compliance Management page to check the pop-up notification of platform verification. At the same time, the platform will also remind you through the MA backend message box or email. Please pay attention to the relevant information. Make sure to complete the operation within 15 days notified by the platform. Failure to submit within the time limit will cause the EU rep to automatically become invalid.




2. Upload supporting documents: Upload files that can prove the real cooperation relationship, such as EU rep authorization agreements and cooperation confirmation letters (up to 3). After confirming the submission, the pop-up will disappear, and the merchant's EU rep information and documents will enter the review stage.


3. Unable to provide authorization agreement: If you choose not to provide an authorization agreement, the system will automatically invalidate the EU rep.



4. EU rep becomes valid after uploading authorization agreement: Merchants can normally add associated products, etc.


5. Review results:


  • Passed: The EU rep remains valid without pop-up prompts;



  • Failed: The EU rep will immediately become invalid. Please bind a new compliant EU rep as soon as possible. (Hover the mouse cursor over the "Invalid" label to see the reason for the verification failure.)



(c) EU Rep Expiry Invalidation Mechanism


All EU rep information has a filled validity period. After expiration, the status column of the EU rep will automatically become "Invalid". After expiration, the EU rep cannot continue to be associated with products and will not be displayed to the EU on the front end.


1. Regularly check the validity period of the EU rep


Check on the Compliance Management > EU Responsible Person page. One month before expiration, the system will remind with a yellow prompt dot. Please also pay attention to the notifications from the platform through the message box and email.



2. System updates EU rep information


If the service period of the designated EU rep has been extended, please update the validity period and upload a new agreement in the backend.




If a new EU rep service has been replaced, add a new EU rep in the backend and re-associate the products.

Why didn't I receive the EU rep verification prompt?
A

The platform will gradually send verification notifications to merchants who have uploaded EU reps. Please pay attention to the pop-ups on the compliance management page, emails and message box reminders in time. If your EU rep information has expired or is invalid, you can also update the information in the backend in advance.
