The Packaging and Packaging Waste Regulation 2025/40, published on January 22, 2025, will replace the current Packaging and Packaging Waste Directive 94/62/EC applicable in Germany, France, Italy, Spain, and other countries, and introduce new provisions in all EU member states. These provisions are designed to improve packaging sustainability, reduce waste generation, and support the development of the EU's circular economy.
The requirements of the regulation are expected to take effect from August 12, 2026. Individual countries/regions have not yet detailed how they will implement specific requirements and how these requirements will affect you. After the relevant information is published in 2026, Amazon will inform you of the compliance requirements and actions required for producer responsibility extension specific to the country/region. Please visit the registration website of the corresponding country/region in the table below to familiarize yourself with the relevant regulations and begin the registration process.
Extended Producer Responsibility Requirements for Packaging within the EU
If you are a packaging producer subject to the EU Packaging Waste Regulation, you need to fulfill certain extended producer responsibility obligations, such as the following:
1. Producer Registration: In each EU country/region where you first provide packaging or packaged goods, you must register on the registration portal established in that country or sign a contract with the producer responsibility organization you choose.
2. Reporting: You must report to the relevant authorities or producer responsibility organizations:
- The quantity of packaging placed on the market in each country/region;
- The types of packaging materials used;
- The weight of the packaging materials; and
- Whether the packaging is reusable or disposable.
3. Fees: You must pay environmental fees to the producer responsibility organizations or environmental agencies in each EU country/region to cover the costs of packaging waste management.
4. Authorized Representatives for Producers Not Established in the Country/Region of Sale: If you are not an EU producer or your company is not registered in the country/region where the goods are sold, you must appoint an authorized representative in the country/region where the goods are sold. The authorized representative acts as your legal representative and fulfills producer obligations. If you are a producer from outside the EU, some countries/regions may require you to appoint an authorized representative. Amazon recommends that you check local requirements before appointing an authorized representative.
Amazon hopes to continue providing extended producer responsibility payment services for packaging in countries/regions where these services are currently available. However, according to the provisions of the EU Packaging Waste Regulation, all marketplaces are required to provide extended producer responsibility producer registration numbers. After the packaging payment service requirements are published in 2026, Amazon will inform you of the latest information about the service.
To prove to Amazon that you meet the requirements, please follow these steps:
- Select your country/region next to the Amazon Seller Central logo in the upper left corner of the Seller Central page.
- Go to Account Status, Manage Your Compliance, and then go to Submit Compliance Information to provide your registration number.
- Click "Save".
You will see a window notifying you that you have successfully submitted your registration number. In countries/regions where registration is public, you will receive a decision on the information you submitted within 7 working days.
The EU Packaging Waste Regulation applies to all types of packaging placed on the EU market, including the following types.
